Introduction The new Italian collective action regime was adopted by law 12 April 2019, no. 31 [1], but – after a further postponement occurred at the end of 2019 – it is now set to come into force on 19 November 2020 [2]. In particular, the remedy will only be available for claims filed after such date. The reform introduces noteworthy changes to the previous regime. First, the new provisions are not included into the Italian Consumer Code (article 140-bis), but they have been placed into the Italian Code of Civil Procedure (below, cpc), at articles from 840-bis to 840-sexiesdecies.
