The Brussels Court of Appeal annuls the decision imposing a 29000€ fine on professional bakers’ association (VEBIC)

I. Facts Vebic is the Flemish association of bakers. Vebic published a magazine entitled “Passie” (among other things). Until 2004, the price of breads in Belgium was set by Law. As the price regulation mechanism was abandoned, VEBIC began to publish a so-called “bread price index”, in Passie, about the evolution of bread’s price. The Belgian Ministry of economy considered this index to amount to an infringement of competition law. The college of prosecutors of the Belgian Competition Council, upon request of the Ministry, launched an enquiry about this “index” which was deemed to be incompatible with article 101 TFEU (ex-81 EC) and similar national law provisions prohibiting price fixing.
