I. Background The Football Association Premier League (“FAPL”) is the governing body of English Premier League football. Every year FAPL organises a competition in which 20 member clubs play against each other. FAPL is authorised by its members to license broadcasters to provide audiovisual coverage of these matches. The rights to broadcast Premier League matches live are offered by open competitive tender and for a fixed term. FAPL grants broadcasters exclusive licenses to broadcast matches and to exploit them economically within their respective broadcasting areas. The licence fees payable vary by territory. To protect territorial exclusivity, each broadcaster undertakes in its licence agreement with the FAPL to encrypt its satellite-delivered signal. Subscribers then require
