The Swedish Market Court upholds the Competition Authority’s interim order imposing an obligation on an electrical company to provide potential customer access to its electricity mains (Ekfors)

Background On February 26, 2010, the Market Court delivered one of its judgments in the long running conflict between the municipality of Haparanda (Haparanda) and the energy company Ekfors Kraft AB (Ekfors). The dispute between the parties mainly concern allegations of abuse of a dominant position through the refusal to provide street lighting services and access to electricity mains in Haparanda. The background to the dispute is that Ekfors holds the concession rights to the electricity mains in Haparanda. The company has also provided Haparanda with street and road light services for several decades. A dispute regarding the payment of the lighting services in the early 2000s caused Ekfors to refuse to turn on the lights when the so-called lighting season (mid-August to mid-May
