The Luxembourg Competition Council adopts the first periodic penalty payments following interim measures (Entreprise des Postes et Télécommunications)

I Background On 22 January 2008, the President of the Competition Council (the “Council”) handed down, for the first time since the law of 17 May 2004 on competition ("Law on competition") came into force, a decision imposing a limited number of interim measures on the public entity Entreprise des Postes et Télécommunications ("EPT"). As no evidence was available to firmly establish any anti-competitive behaviour, in his Decision the President of the Council imposed only two concrete remedies: – Prohibiting EPT from bundling the product IPTV (television by telephone) up with its “Integral” product or with any other bundled offer. The President considered that such a bundling would probably be construed as abusive bundling. –
