The EU Court of Justice clarifies the eligibility requirements of claims for indirect damages caused by a violation of Art. 101 TFEU (Otis / Land Oberösterreich)

The parties Otis GmbH, is an Austria based manufacturer and provider of maintenance services for elevators and escalators. Taken over in 1969, they are now a subsidiary of the American Otis Elevator Company Corp. Schindler (Schindler Liegenschaftsverwaltung GmbH and Schindler Aufzüge und Fahrtreppen GmbG), is the Austrian subsidiary of the Swiss Schindler AG, which alsoproduces and maintains elevators and escalators. Kone AG, based in Vienna, it belongs to the Kone Corp., a Finnish producer of elevators, escalators and automatic doors and gates. ThyssenKrupp Aufzüge GmbH (ThyssenKrupp), is also a manufacturer of elevators and escalators based in Vienna. The company belongs to the German ThyssenKrupp Elevator AG.
