NB: This article will be published in Concurrences N° 2-2014, Case comments: International Policy The Agreement between the European Union and Switzerland concerning cooperation on the application of their competition laws came into force on December 1, 2014 (hereafter “Cooperation Agreement” and the “Parties”) [1]. This is the first so called “second generation agreement” concluded by either Party, in that it allows the exchange of information without the consent of the undertakings [2]. Although it is very similar in structure to the Agreement between the USA and the EU, its purpose and content are quite different [3].
