The Spanish Competition Authority closes a resale price maintenance case, after applying the de minimis rule (El Corral de las Flamencas)

On December 3, 2009, the Spanish Competition Authority(Comisión Nacional de la Competencia, “CNC”) closed a case of possible infringement of Article 1 of the Law 15/2007, for the Defense of Competition (“LDC”), involving the company El Corral de las Flamencas, S.L. (“El Corral”) fixing resale prices in the textile market. Although there was evidence that El Corral had fixed resale prices to its distributors, the CNC considered, based on the legal and economic context, that this conduct did not significantly affect competition.
