On 3 December 2009, the President of the Amsterdam Court of First Instance (the “President”) accepted an interim proceedings claim brought by four former Kia Nederland BV (“KIA Nederland”) repairers. The repairers claimed that KIA Motors Nederland BV (“KIA Motors”), which replaced KIA Nederland as the importer of the KIA brand in the Netherlands after the former company had been declared bankrupt, had unlawfully refused to reappoint them as authorized repairers within KIA Motors‘ selective
