The German Federal Court of Justice decides on the relevant definition of the gas supply market (Stadtwerke Uelzen)

On 10 December 2008, the German Federal Court of Justice (FCJ) issued a decision on the definition of the relevant gas supply market [1]. The case concerned the question whether a regional gas supplier had a dominant position which could have been abused. Facts and proceedings Stadtwerke Uelzen is a regional gas supplier delivering natural gas to end consumers in its supply area. According to the Cartel Office of Lower Saxony, the company had abused its dominant position by demanding excessive charges for the gas supply from November 2005 to March 2006. Therefore, the
