The French Minister of Economy fines for the first time a company for failure to notify a merger prior closing (Pan Fish)
By a letter dated 30 August 2006, a Norwegian company called Pan Fish informed the French Minister of Economy (the Minister) of a closed merger operation [1] which it had failed to notify pursuant to the French merger control rules. This transaction related to the acquisition by the second world biggest farmed salmon producer, Pan Fish, of the fifth world biggest producer, Fjord Seafood.
In its letter, Pan Fish indicated that the failure to notify resulted from a miscalculation of Fjord Seafood's turnover. This error came to the Minister's and
