The French Competition Authority adopts interim measures to protect competition in a public tendering in the maritime sector (SNCM, Corsica Ferries, Compagnie Méridionale de Navigation)

The Conseil de la concurrence recently issued an interim measures decision in which it ordered an injunction against the Société Nationale Maritime Corse Méditerranée (SNCM) on the grounds of Article L. 464-1 of the French Commercial Code. Background The public authorities in Corsica and the Corsica Transport Office (“OTC”) regulate the maritime policy of the island and grant subsidies to transport companies in charge of public services. In March 2006, they organized a tender procedure at European level for the renewal of the allocation of the delegation of the public service for maritime transport between the harbour in Marseille and those in Corsica, from 2007 to 2012.
