The Polish Competition Authority establishes that the telecommunications incumbent abused its dominant position concerning pre-selection services (Telekomunikacja Polska)

On the 31st of December 2004, the President of the Office for the Competition and Consumers Protection (hereafter, “OCCP President” or “President of the Office”) issued a decision in which he condemned the practices of Telekomunikacja Polska S.A. (hereafter “TP S.A.”) concerning the alternative operators' pre-selection service as being contrary to the prohibition of dominant position abuse. The present decision stemmed from the complaint of Netia S.A., an alternative operator of TP S.A. This enterprise has accused TP S.A. of preventing consumers from using the pre-selection service by restricting the conditions and in distorting competition between telecom operators.
