The Competition Commission of India (CCI) recently found that SAAR IT Resources Private Limited (OP 1), CADD Systems and Services Private Limited (OP 2) and Pentacle Consultants (I) Private Limited (OP 3), collusively manipulated the process of bidding, by rigging the bids for the tender floated by Pune Municipal Corporation (OP 4). [1] The tender was for ‘selection of agency for carrying out geo-enabled tree census using GIS & GPS Technology’. The conduct of OP 1, OP 2 and OP 3 amounted to an infringement of Section 3(3)(d) of the Competition Act, 2002 (Act).
