The French Minister for Economics sanctions for the first time for a breach of merger remedies (Carrefour-ED/Treff)

In its decision dated 7 November 2003 [1], the Minister had granted conditional clearance to the acquisition by the Carrefour group, via its subsidiary Erteco, of the company Sonnenglut Weinkellerei (hereinafter Sonnenglut), owner of food discount stores operating under the brand Treff Marché. Having identified the risk of unilateral effects in one of the areas concerned by the operation (Belfort), the Minister had cleared the merger provided the Carrefour group divests one of the discount stores located in the Belfort territory, either the Treff Belfort shop or the ED Belfort shop. According to the terms of the commitments letter, the group Carrefour was supposed within a six-month period as of the Minister clearance decision, to submit to the Minister's approval a buyer, meeting
