The Competition Commission of India fines three aluminium phosphide tablets manufacturers for engaging in bid-rigging (Food Corporation of India)

SUMMARY In tendering to the Food Corporation of India, three manufacturers of Aluminium Phosphide Tablets were found to have quoted the same rates, to have reduced rates by the same margin in negotiations, and to have collectively abstained from bidding. The CCI fined the parties 9% of average turnover (totaling more than Rs. 3 billion (about USD 55 million)). The case is currently under appeal before the COMPAT. Background: In February 2011, the Food Corporation of India (FCI) drew the attention of the Competition Commission of India (CCI) to increases in the cost of procuring Aluminium Phosphide Tablets (ALP) from four manufacturers of ALP: Agrosynth Chemicals Limited (ACL), Excel Crop Care Limited (ECCL), Shandhya Organic Chemicals Private Limited (SOCPL), and United Phosphorous
