On 13 August 2003, a complaint was lodged before the Autorità Garante della Concorrenza e del Mercato (hereinafter, “AGCM”). The complainant alleged the existence of an anticompetitive agreement reached between several manufactures of marine and yacht coatings : Boat - Boero Attiva Marine and Protective Coating Genova S.p.A. (“Boat”), Hempel S.r.L., International Paint Italia S.p.A (“International Paint”), Jotun Italia S.p.A (“Jotun”) and Sigma Coatings S.r.L (“Sigma”).
