Background information The judgment in Commission v EnBW issued by the Court of Justice ("CJEU") on 27th February 2014 may constitute a landmark case in the context of access to cartel-related documents -in particular, leniency materials- held by the European Commission ("EC") which could be used by third parties to support actions for the damages arising as a result of a cartel. The story begins with the sanction on the gas insulated switchgear ("GIS") cartel set by the EC on 27th January 2007. EnBW, which considers itself adversely affected, had the intention to file damage actions against the members of the GIS cartel and requested access to the cartel-related documents in the possession of the EC on the basis of Regulation 1049/2001 (“Transparency Regulation”).
