A good friend, a great judge, a spectacular thinker and scholar of antitrust law matters, Doug well deserves a gift at the quality of this book. When I was hosting him in Istanbul for a conference I organized in Spring 2016, I had asked him the secret of his never ending passion to antitrust law. He had said that he feels he is using the advantage of having a number of hats and perspectives, which allows him to keep a fresh eye on contemporary issues of competition law. No one has had a greater impact on antitrust law, writ large, or on the international aspects of antitrust law, than Doug Ginsburg. He had the foresight in the mid-1980s, when he served as Assistant Attorney General for the Department of Justice’s Antitrust Division, to shine a spotlight on international competition policy and to see it as something the entire world could, and should, embrace. At the same time, he brought clear thinking and vigorous enforcement to U.S. antitrust law, ensuring that both the government and the courts had a clear understanding of the economic impact of real-world arrangements. He emphasized the importance of allowing legitimate competition to thrive, while at the same time intervening when necessary to protect consumer welfare. It has been my great privilege and pleasure to be Doug’s friend and colleague in these efforts over the years, and I look forward to his continuing contributions.

Judge Ginsburg is a tireless champion of economic freedom and rigor in government decision-making. It was one of the great honors of my tenure as Assistant Attorney General to present Judge Ginsburg with the John Sherman Award - the highest antitrust honor given by the Department of Justice. Judge Ginsburg’s career in public service and his scholarship have shaped the way that we at the Antitrust Division understand and practice our enforcement mission. I can think of several times when his way of approaching a complex problem inspired my own. He brought economic rigor to the Antitrust Division during his own time as AAG, and the same value is apparent in his opinions on the D.C. Circuit. Whether as antitrust enforcers or practitioners, we hold ourselves to a higher standard of explaining economic incentives because, in part, Judge Ginsburg taught us we must.
