The Audiencia Provincial de León has dismissed the appeals lodged by two truck manufacturers, Volvo and DAF Trucks, against a commercial court judgment which awarded damages amounting to €10,906 after the Court of Justice of the European Union (CJEU) clarified the temporal application of the Damages Directive to the truck cartel litigation. In October 2019, a commercial court of León partially upheld the damages action filed by a trucks purchaser who claimed €38,148 as overcharge for the purchase of three trucks (Commercial Court nº 8 of León, judgment of 15 October 2019, appeal nº 170/2018).
