An appeal was brought before the Court of Justice against a judgment of the Court of First Instance declaring inadmissible an action for annulment of a final decision of the Commission. The latter rejected the classification as aid of a series of measures which benefited Frankfurt-Hahn airport, Ryanair and the airlines using that airport, with the exception of certain measures in favour of the latter which were classified as aid compatible with the internal market. The Court rejected this appeal without much surprise, recalling and specifying the conditions under which an operator may be considered individually and directly concerned by such a decision.
