CASE COMMENTS: STATE AID - EUROPEAN UNION – EMPLOYMENT AID – APPLICABILITY TO AN UNDERTAKING PROVIDING LOCAL PUBLIC TRANSPORT SERVICES

Employment aid: The Court of Justice of the European Union considers that the European Commission’s Decision 2000/128/EC of 11 May 1999 concerning aid granted by Italy to promote employment is applicable to an undertaking which, on the basis of a direct and exclusive award by a municipality, has provided local public transport services and has benefited from reductions in social security contributions under national legislation which was declared by that decision to be incompatible, in part, with the common market (Istituto nazionale della previdenza sociale / Azienda Napoletana Mobilità)

Les faits à l’origine de l’affaire ayant donné lieu à l’arrêt sous commentaire sont particulièrement anciens. Ils remontent en effet à l’adoption en 1984, par l’Italie, d’une législation en faveur de l’emploi, qui a instauré un “contrat de formation et de travail”. Celui-ci était un contrat à durée déterminée, assorti d’une période de formation, prévu pour l’embauche de chômeurs n’ayant pas plus de 29 ans. Les embauches effectuées par le biais de ce contrat bénéficiaient, pendant deux ans, d’une exonération de charges sociales dues par l’employeur. Cette exonération s’appliquait de manière uniforme, automatique et non discrétionnaire sur tout le territoire national.
