Limited discretion : The General Court of the European Union annuls partially the decision of the Commission regarding its assessment of the (in)ability to pay of the company both in the decision and in a letter rejecting a request for a new assessment, but doesn’t reduce in any way the amount of the fine in the frame of its unlimited jurisdiction (Westfälische Drahtindustrie)

“Club Zurich”, “Club Europe”, “Club España”, “Club Italia” : les sociétés intervenant sur le marché de l’acier de précontrainte n’avaient que l’embarras du choix des réunions pour s’entendre. Ce qu’elles n’ont pas manqué de faire de 1984 à 2002. Une entente aussi importante ne pouvait rester indéfiniment secrète, en particulier pour la Commission, qui, dans sa décision du 30 juin 2010, C (2010) 4387 final, a sanctionné le comportement de dix-huit “entreprises”, portant sur la fixation de quotas, le partage de clientèle, la fixation des prix et l’échange d’informations commerciales sensibles, tant au niveau européen (“club Zurich”, puis “club Europe”) qu’aux niveaux régional et national (“club España” et “club Italia”).
