Collective labour agreement: General Advocate Wahl invites the Court of Justice of the European Union to consider that collective labour agreement are within the scope of Article 101 TFEU if they are entered into in the interests of and on behalf of self-employed persons, but outside the scope Article 101 TFEU of if they are entered into in the interests of and on behalf of employees, whose employment and working conditions they directly improve by genuinely and effectively preventing social dumping (FNV Kunsten Informatie en Media/Staat der Nederlanden)

Le 11 septembre 2014, l'avocat général Nils Wahl a présenté ses conclusions dans l'affaire C-413/13 (FNV Kunsten Informatie en Media / Staat der Nederlanden) concernant la demande de décision préjudicielle présentée par le Gerechtshof Den Haag (la Cour d’appel régionale de la Haye) à propos de l'application des règles de concurrence européenne aux conventions collectives de travail prévoyant dans l'affaire au principal notamment les rémunérations minimales que devaient percevoir les musiciens remplaçant les membres d’un orchestre en nouant, à cet effet, une relation de travail avec cet orchestre. Eu égard aux doutes qu’il entretient quant à l’interprétation correcte de l’article 101 TFUE, le Gerechtshof ‘s-Gravenhage a décidé de surseoir à statuer et de déférer à la Cour les questions préjudicielles
