Antitrust fine quantification : Results of an international survey

Un programme de recherche international regroupant des avocats et des académiques a été constitué sous l’égide de Concurrences afin de comparer les modes de calcul des amendes sanctionnant des pratiques anticoncurrentielles. Une double méthodologie émerge de cette comparaison internationale suivant qu’un montant de base éventuellement pondéré est ou non défini. Si le calcul d’un montant de base peut apparaître comme garant d’une certaine prévisibilité, l’autre mode de calcul sans montant de base présente l’intérêt de prendre en compte explicitement le dommage causé par la pratique anticoncurrentielle à l’économie. En effet, ce dernier élément de l’amende peut contribuer efficacement à l’objectif de dissuasion des pratiques anticoncurrentielles.

1. In January 2010, the European Commission held an economist workshop on the quantification of harm caused by the infringements to the EU antitrust rules. [1] Debates dealt with a range of obstacles to the enforcement of the victims' rights to damages. Those obstacles derive often from legal or procedural rules in Member States, giving rise to legal uncertainty. [2] More precisely, three questions were raised about the definition, the quantification of damages and the quantification of fines by reference to those damages. The first two questions were addressed by innovative contributions from the recent economist workshop. The last question of the quantification of fines remained quite uncovered as if the evaluation of damages had to be followed by a definite amount of fines. This
