The reform on vertical restraints continues to move forward and with it the debate between all points of view. For example, the previous Review of Journals mentioned articles responding to each other in the European Competition Journal. The author returns to the famous "Vedettes vendéennes" case, through the decision handed down by the Paris Court of Appeal on 9 June 2009, on referral after cassation. Recalling the economic definition and the use in competition law of the concept of incremental cost applied to the diversification activities of an operator generally entrusted with a public service mission, the author notes that the Court of Appeal confirms the decision of the Competition Council without, however, finally answering the question raised by the Court of Cassation. He also criticizes the segmentation made by the case law between the costs to be allocated to the activity under monopoly and those relating to the activity in competition, leading to a full allocation of the cost of a good to one or other of the activities, while recognizing, however, the difficulty of applying such economic concepts to public operators.

Competition rules and devolution of public service delegations, M. Bazex (D. Adm., n° 7, Jul. 2009, p. 22)

The author recalls, through the commentary on decision No. 09-D-18 on the Régie des transports de Marseille, the now well-established case law on the division of powers between the administrative courts and the Competition Authority, but also on the possible accumulation of powers: a call for tenders may in fact be the subject of proceedings before the administrative contract judge and before the Competition Authority to judge the behaviour of companies when the contract is awarded. The author notes, however, that the Competition Authority has made some progress with regard to the object and scope of its control. Even if, in the end, the practice was not adopted, the authority examined, during the tender procedure, whether or not a temporary grouping of enterprises was justified and whether or not there was a possibility of abuse of a dominant position by the enterprises participating in the grouping.

8.1. General

The Authority’s Audit Advisor: A homonym more than a counterpart to the Community Audit Advisor, É. Barbier de La Serre et C. Macé de gastines (RLC 2009/20, No. 1429, p. 66)

The main purpose of this article is to dispel any confusion that might arise from the homonymy between the function of the Hearing Officer of the newly created Competition Authority and that of the Hearing Officer at the Commission. The former, a mere personality available to remedy any difficulties upstream of the procedure without having to wait for the meeting of the panel, according to the authors of the article, is devoid of the decision-making powers of the latter. The separation of the investigative and decision-making functions, which is much clearer in French competition litigation than at the Community level, largely explains this difference. Nevertheless, these authors argue resolutely in favour of granting decision-making powers to the Competition Authority’s Hearing Officer. Thus they envisage entrusting him with the classification of business secrecy and the granting of time limits, a task that is currently the responsibility of the general rapporteur. Above all, however, Éric Barbier de La Serre and Clémence Macé de Gastines suggest extending his intervention to procedures that do not give rise to a notification of objections but that may nevertheless raise serious questions with regard to the rights of the defence, in particular procedures for commitments and precautionary measures.
