e-Competitions State Aids Research Program: Application of EC State aid Law by national Courts

Dans cet article, le Professeur Jean-Yves Chérot présente les deux premières séries de résultats du programme de recherche du bulletin e-Competitions dédiés aux décisions juridictionnelles nationales en matière d’aides d’Etat. Le Professeur Chérot et son équipe de chercheurs - universitaires et praticiens - ont recensé 104 jugements et arrêts rendus par les juridictions françaises sur une période plus de trente ans, de 1967 à 2005. La période de 2006-2007 a été couverte pour la France, et dans une moindre mesure pour la Belgique, l’Allemagne et les Pays-Bas par des auteurs indépendants; leur travail est également présenté dans cet article avec une préface de Me Jacques Derenne. Ce programme de recherche e-Competitions se poursuit sur d’autres Etats membres, à la fois pour recenser et commenter les décisions anciennes publiées et continuer à tenir à jour un recueil commenté de ces décisions. Ce programme de recherche est ouvert à toutes personnes intéressées.

PART I Jean-Yves Chérot According to the European Court of Justice (ECJ), the supervision of State aid is a matter for both the Commission and, having regard to the direct effect which the last sentence of article 88 (3) EC has been held to have, the national courts. The principal and exclusive role conferred on the Commission by articles 87 and 88 EC is to hold aid to be incompatible with the Common Market where this is appropriate. The national courts have to safeguard rights which individuals enjoy as a result of the direct effect of the prohibition laid down in the last sentence of article 88 (3) EC, i. e. the prohibition for the State to implement new State aids projects before the final decision of the Commission.
