Due process in competition proceedings

In 2009 and 2010, important fora decided to address the question of due process in competition proceedings. The USCIB, the ICC, the OECD, the European Commission and all the prominent business organizations in Europe have commented on this issue. This is the logical consequence of the high fines that are imposed on companies for infringement to competition rules. In many jurisdictions, including Europe, such infringements are now much more sanctioned than bribery, money laundering or pollution. This is the reason why many academic authors, as well as business circles, consider that competition proceedings should protect more the rights of defense and, more generally, comply with the “fair process” standards as defined by the European Court of Human Rights.
