Towards an optimal enforcement of competition rules in Europe: Time for a Review of Regulation 1/2003?

The Fifth annual conference of the Global Competition Law Centre, held in Brussels on 11-12 June 2009, was dedicated to the Commission’s review of EC Regulation 1/2003. These contributions are the summaries of six work groups: I) The directly applicable exception system and the direct applicability of Article 81(3) EC; II) Relationship between EC competition law and national competition law; III) The enforcement system for Articles 81 and 82 EC; IV) Enforcement by national competition authorities and the European Competition Network; V) Cooperation between competition authorities and judicial authorities; VI) International cooperation. The full proceedings will be published in print version in the course of 2009/2010. This is a collective work; the names of the contributors to the six work groups appear at the beginning of each section below.

Global Competition Law Centre, Brussels, 11 & 12 June 2009 PRESENTATION Massimo Merola Lawyer When the decision to launch a project on the reform of Regulation EC No. 1/2003 (“Regulation 1/2003”) was taken within the Global Competition Law Center (GCLC), its aims included: (i) to provide a broad overview of all the problematic issues related to the application of this fundamental piece of legislation in EC competition law; and (ii) to pass on to the Commission a study formulating appropriate suggestions for the way forward in the field. It was our intention that our study's forward-looking approach would be a suitable complement to the report that had been recently released by the Commission, which focused more on fact-finding.
