Morocco: New guidance for the implementation of competition law compliance programs

The Moroccan Competition Council has just published a guide related to the implementation of competition law compliance programs in companies and professional organizations, which also contains a reminder of the applicable competition law rules and could therefore be considered the first guidelines of the Competition Council.

I. Introduction 1. The Moroccan Competition Council (hereinafter the “Competition Council”) has just published on its website a guide entitled “Guide related to the implementation of competition law compliance programs in companies and professional organizations.” As discussed below, this guide contains a significant number of instructions relating to compliance programs that may be adopted by companies and professional organizations. It also contains a number of practical recommendations as to how companies and business organizations should or should not behave in order to ensure compliance with competition law by their employees or members. Finally, it is also accompanied by two appendices listing, in Appendix 1, the main rules of competition law and, in Appendix 2, the particularities
