Everyone is, has been and will be confronted with non-competition clauses in his or her professional life, whether in an employment contract, in a contract for the supply of goods or services, in the context of the transfer of a business or other. Non-competition clauses are omnipresent in business life and aim to protect knowledge, know-how and clientele. However, their regime can be complex, scattered and even confusing for the professionals who are confronted with them. Indeed, the abundant jurisprudence in labour law and the absence of a general regime in economic law make this subject difficult to access. This book aims to provide practical answers to the various questions that the reader, whether a legal practitioner or not, is likely to ask in this area.

The authors analyse the subject in a transversal way by means of 75 questions (56 questions and 19 sub-questions) which concern both non-competition clauses in labour law and in economic law.

From the formal conditions to be respected in labour law to the specific regime of the commercial agency contract, including the tax and social treatment of the financial compensation paid to the worker and competition law, the authors address a wide variety of subjects that will enable legal professionals and any professional confronted with a non-competition clause to understand its scope and consequences.
