Decisions requesting information: The Court of Justice of the European Union demands from the General Court a more thorough review of the Commission’s statement of reasons and annuls the Commission decisions regarding companies active in the cement industry (HeidelbergCement / Schwenk Zement / Buzzi Unicem / Italmobiliare)

Le 10 mars 2016, la Cour de justice de l'Union a rendu quatre arrêts dans les affaires C-247/14 (HeidelbergCement / Commission), C-248/14 (Schwenk Zement / Commission), C-267/14 (Buzzi Unicem / Commission) et C-268/14 (Italmobiliare / Commission). Ils devraient mettre un terme à la pratique de la Commission consistant à utiliser les prérogatives que lui reconnaît l'article 18, paragraphe 3, du règlement (CE) n° 1/2003, de demander, par voie de décisions contraignantes, des renseignements aux entreprises, pour soumettre ces dernières à des demandes massives de renseignements excessivement larges, systématiques, voire carrément exploratoires (fishing expedition) par rapport aux maigres indices dont dispose la Commission laissant suspecter une infraction aux règles de concurrence.
