The authors of this article offer a detailed commentary on the ruling handed down on 19 January 2010 by the Paris Court of Appeal in the steel trading cartel case, which considerably reduced the record fines imposed by the Competition Council and, beyond that, profoundly questioned the Competition Authority’s sanction policy, not only with regard to the criteria to be taken into account in setting sanctions, but also with regard to the method of calculating the sanction.

It is a plea for a pragmatic implementation of the new rules resulting from the 3rd energy package. Indeed, the author recalls the various constraints applicable to former public monopolies under both competition and regulatory law which in this context directly influence, not the behaviour of companies, but the very organisation and structure of the latter. However, the author notes, in view of the current state of jurisprudence and regulation, particularly in the energy sector, a very clear strengthening of these rules. Indeed, alongside competition law, which can impose structural remedies, notably through the transfer of activities, the new Community provisions in this regulated sector are a real attack on the autonomy of energy sector companies in terms of corporate governance. The latter are now under the very strict control of the regulatory authorities.
