Organizing economics in competition law enforcement: Varying solutions, constant challenges

Avec la croissance en importance du ?more economic approach? dans la pratique des autorités de la concurrence, se pose la question de la facon la plus appropriée d’intégrer les économistes et l’analyse économique dans l’application du droit de la concurrence. L’article, base sur le discours donné par l’auteur lors de la Conférence Annuelle 2009 de l’Association of Competition Economics (ACE) à Berlin, prend pour sujet quelques-unes de plus importantes questions en ce regard, surtout la question de l’interaction et collaboration entre économistes et juristes au sein d’une autorité de la concurrence. L’article avance des arguments en faveur de la conclusion que des ?best practices’ concernant la production et présentation des analyses économiques semblent être plus importantes pour le succès du ?more economic approach’ que la quête à une architecture interne prétendument ?idéale’ de l’autorité de la concurrence.

It is a pleasure and also a privilege for the chief economist of the hosting country's competition authority to provide the kickoff to one of the most prominent and vitally important annual conferences on competition economics in Europe. The good-sounding and bejewelling title chief economist also provides the cue to one of the most topical challenges of effective and sound competition policy: the appropriate integration of economists and sound economic analysis in competition law enforcement. In the following, I want to present some thoughts on three organizational aspects which are highly relevant for meeting this challenge successfully: (I.) the internal architecture of competition authorities, (II.) the effective interplay (“fair play”) on the pitch of competition law
