Powers of investigation and procedural rights and guarantees in EU antitrust enforcement: The interplay between European and national legislation and case-law

Cet article traite des pouvoirs d’enquête de la Commission européenne et des autorités de concurrence des Etats membres quant à l’application des articles 81 et 82 du traité CE, ainsi que des droits et garanties procédurales quant à la mise en œuvre de ces pouvoirs. L’auteur analyse en particulier la question de la détermination du droit applicable (droit des Communautés Européennes ou droit de l’Union européenne, droit national ou encore Convention européenne des droits de l’homme), de la juridiction compétente et du fondement sur lequel est déterminé la loi applicable (législation européenne et nationale, jurisprudence de la Cour de justice et du Tribunal de première instance, juridictions nationales et Cour européenne des droits de l’homme).

I. Powers of investigation 1. Different ways of gathering intelligence and evidence 1. Under Regulation No 1/2003, [1] the European Commission (hereafter also: «the Commission») and the competition authorities of the Member States (hereafter also: «the national competition authorities»), forming together a network of competition authorities (hereafter also: «the competition authorities» and «the European Competition Network»), [2] have the task of detecting and punishing violations of Articles 81 and 82 EC. [3] To fulfil this task, they need intelligence and evidence of such violations. 2. The competition authorities could collect the necessary information (intelligence and evidence) from various sources. Information could be obtained in particular from complainants or other third parties.
