Brazilian competition enforcement: New year, new law

Depuis le 1er décembre 2011, le Brésil possède une nouvelle loi sur la concurrence (N° 12.529/2011) qui restructure considérablement la mise en oeuvre du droit de la concurrence et son cadre institutionnel. Cette loi entrera en vigueur le 29 mai 2012 et devraitt améliorer l’efficacité du droit de la concurrence au Brésil. L’auteur dresse un tableau général positif de cette réforme tout en relevant les défis auquels le nouveau CADE devra faire face.

I. Introduction 1. On December 1st, 2011, the New Brazilian Antitrust Law (N° 12.529/2011) [1], which significantly restructures the competition enforcement in Brazil, was published. After a decade of discussions and six years of pendency in the Congress, the Law was approved by the President Dilma Rousseff with some important and polemic vetoes [2]. 2. The new Law, which replaces Law nº 8.884-94, will come into force on May 29, 2012 after 180 days of vacatio legis. 3. The main objective of the reform is to achieve a more efficient and effective competition defense system.
