Some reflections on the "Folz Report" on sanctions for anti-competitive practices - A sword in the water or a promising destiny? R. SAINT-ESTEBEN (RLDA Dec. 2010, 55, n° 3165, p. 39)

In this thorough and comprehensive article, Robert Saint-Esteben gives us his practitioner’s reactions to the reading of the Folz-Raysseguier-Schaub report on predictability in the calculation of competition fines, commissioned by the Minister of the Economy following the ruling handed down on 19 January 2010 by the Paris Court of Appeal in the "steel trading cartel" case. The author’s critical reading of the case highlights the author’s comments on the lack of any real theoretical analysis at the legal level. He insists, in particular, on the preponderant role played in both European and national decision-making practice by the need to ensure, through the amount of the fine, the overall deterrence of the sanction, to the detriment of the principles of proportionality and the personality of penalties. Turning now to the recommendations made by the Three Wise Men, Robert Saint-Esteben praises the audacity shown by the authors of the report in addressing procedural issues that go beyond the strict issue of penalties, such as the creation of an independent sanctions committee alongside the Authority’s college or the recommendation that a genuine adversarial debate on sanctions be held as early as the written procedure stage, it also notes that many of the recommendations made by the Folz-Raysseguier-Schaub mission would, if they were to be implemented, call for intervention by the legislature, which the Minister does not seem to want to accept. As regards the method of calculation itself, the author essentially agrees with the report’s recommendations, but has reservations, for example, about the proposal to reduce the "damage to the economy" to a simple weighting factor, arguing instead that it should remain an integral part of the assessment of the anti-competitive practice.

In the midst of the debate on the future implementation of the NOME law, we can only recommend that you read Pierre Collin’s conclusions on the appeal filed by the Powéo company against an order setting regulated electricity rates, which the Conseil d’État has partially annulled. In particular, the appeal was based on the insufficient increase in EDF’s regulated tariffs, which placed EDF in a position of automatic abuse of its dominant position. In his conclusions, Pierre Collin departed in particular from the position adopted by the Conseil d’État in its judgment of 10 December 2007 on regulated natural gas tariffs, by considering that each of EDF’s regulated tariffs should constitute a relevant market. In addition, it considers that, in the present case, the complaint concerning the margin squeeze cannot be attributed in its entirety to the contested order but also results, first, from the conditions of supply upstream and, second, from the level of regulated tariffs downstream.

Reference for a preliminary ruling by the Court of Justice of the European Union by judgment of 20 July 2010 (Case C-265/08) recalls that Member States may regulate the price of natural gas supply and thus set regulated tariffs, in accordance with the 2003 Directive liberalising the energy sector and the necessary protection of the final consumer, but makes the lawfulness of such regulation subject to compliance with a number of strictly defined conditions.
