1. On December 2, 2008 the new Bulgarian Law on the Protection of Competition (“LPC”) came into effect. Shortly after Bulgaria joined the EU in 2007, it became clear that the patchwork additions that have been made over the years to the existing 1998 Law on the Protection of Competition (“1998 Law”) were not sufficient to comprehensively incorporate the EC Council Regulation 1/2003 and 139/2004 and to clarify the jurisdiction and cooperation between the Bulgarian authority, the European Commission and the other Member States competition authorities. Bulgaria: The 2008 Competition Act
La nouvelle loi bulgare sur la concurrence, entrée en vigueur le 2 Décembre 2008, a comme objet l’harmonisation du droit de la concurrence bulgare avec les règles communautaires. La loi introduit les fondations d’un programme de réduction et d’exemption des sanctions ainsi que une action en dommage-intérêts en cas de violation du droit de la concurrence. La loi modifie les règles de notification obligatoire des concentrations et substitut la présomption de position dominante fondée sur une part du marché de 35% avec un test multi-critères. La loi supplémente et clarifie d’une manière substantielle les règles de procédure et confère des pouvoirs renforcés à l’autorité nationale de concurrence comme les mesures provisoires et les inspections.
