The Paris Court of Appeal quashes the decision of the French Competition Authority in a margin squeeze case (SFR / France Telecom)

On 27th January 2011, the Paris Court of Appeal, following two remands from the Supreme Court, finally handed down a decision confirming the last decision of the French Supreme Court (Cour de cassation)in the margin squeeze case in the telecom sector. In its last decision, the Supreme Court [1] set aside the former decision of the Court of Appeal by reminding the two conditions required to establish a margin squeeze practice: the existence of losses incurred by the competing operator on the downstream market and the indispensable nature of the facility supplied by the dominant operator.
