The Estonian Supreme Court issues a landmark decision on excessive pricing and interaction between competition law and regulation (Eesti Telefon)

1. Background information AS Eesti Telefon (ET, currently Elion Ettevõtted AS) is the Estonian incumbent telecom operator. The Estonian Competition Board (ECB) initiated proceedings against ET after ET had implemented a price rise to its on-net telephone services provided at a fixed location. According to the decision that was finally taken by the ECB the conduct of ET amounted to excessive pricing that was prohibited under the Competition Act in force at the time of the proceedings as an abuse of dominant position. ET challenged the prohibition decision of the ECB and after being invalidated by the court of first instance and the circuit court, the legality of the decision of the ECB was finally ruled on by the Supreme Court.
