Collective dominance

The Judgment of the Court of First Instance of 10 March 1992 "Italian Flat Glass’" was the first case in which court procedures confirmed that a collective dominant position can take place in oligopolist markets when ”two or more undertakings jointly have, through agreements or licences, a technological lead affording them the power to behave to an appreciable extent independently of their competitors, their customers and ultimately of their consumers”. © European Court of Justice
