WEBINAR #5 Failing firm defence: A new era for mergers?

This webinar was organised by Concurrences as part of the "#NewAntitrust Webinar Series" dedicated to competition policy in the aftermath of the Covid-19. Paul Csiszár (Director of Basic industries, Manufacturing and Agriculture DG COMP), Antoine Chapsal (Partner, Analysis Group), Axel Gutermuth (Partner, Arnold & Porter) and Jonas Koponen (Partner, Linklaters) discussed the approach of competition authorities with regard to the “failing firm defence” argument. The current health crisis is shining a new light on the “failing firm defence” argument in merger policy. Are the competition authorities ready to review their views on the interpretation of their long-standing practice? The recent UK CMA decision clearing Amazon/Deliveroo could be the first step in this direction. The #NewAntitrust Webinar Series is held with the support of Concurrences partners.
