Paul Nihoul pointed out that sometimes competition law procedures can take time to be implemented. This raises the question of whether the duration of the proceedings can have an impact on the amount of the fine imposed. This issue is currently addressed in the case Reinforcing bars cartel in which three subsequent decisions were adopted between 2002 and 2019. This case is currently under review before the General Court. In this case, the European Commission reduced the fine up to 50%.
