Synthesis
Ingrid Vandenborre introduced the webinar. There has been a lot of developments in the UK litigation landscape over the recent period. Regarding private enforcement, there is a nascent collective action regime which is likely to be significantly influenced by the very recent Merricks judgement of the UK Supreme Court (Case UKSC 2019/0118). Indeed, that judgement will probably lead the way to more collective actions in private enforcement. Regarding public enforcement, there have been many antitrust and merger decisions of the Competition and Markets Authority (“CMA”) over the recent months. The Competition Appeal Tribunal (“CAT”) is a dedicated review court for these decisions and has been decisive in shaping review of mergers and antitrust decisions.
