David Bosco a introduit le panel en saluant le focus du cycle de conférences sur la pratique judiciaire. Ceci est d’une pertinence particulière car le régime des actions privées est de lege lata entre les mains des juges. Si les législateurs et les régulateurs ont eu leur rôle, la jurisprudence de la Cour de justice est aujourd’hui la source des grands jalons du droit de l’action privée. Parmi les grandes questions à ce sujet : comment définir le périmètre des débiteurs de réparation ? Comment considérer le lien causal entre l’infraction et le préjudice ? Ces questions seront à l’agenda du panel.
