Market place and selective distribution system - Which perspectives ?

While the Competition Authority is open to analysing the effects of the ban on resale on market places, the reflection is not yet complete. Things have not yet been decided and are likely to change in France and in Europe.

This is a hot topic. The European Commission has been conducting a major survey on e-commerce for several months now, with a view to updating it a few years after the 2010 regulation came into force. It is true that things are changing very quickly in terms of e-commerce. E-commerce is developing exponentially, particularly the market places which have become very important and which consumers seem to be in favour of. (Small) retailers are also finding market places of interest, which allow them to gain notoriety and increase their sales volumes more easily. On the other hand, suppliers’ reactions are more mixed. Some admit that the market places are an inevitable development, others are more attentive, while others are resolutely hostile to them and maintain an absolute ban, a risky position in view of certain recent decisions.
