Juliette Enser recalled that as of 1 January 2020, the UK had ceased to be part of the EU competition regime. The CMA (and the UK concurrent regulators) have therefore become responsible for cartel enforcement including in cases where the European Commission is investigating. They apply Chapters 1 and 2 of the UK Competition Act, which largely mirror the prohibitions of Articles 101 and 102. This has important implications for businesses, particularly concerning the leniency procedure. Companies considering applying for leniency for conduct involving both the UK and the EU must now always submit a full leniency application to the UK to obtain immunity from sanctions.
