The Spanish High Court quashes the Competition Authority’s fine against a railway company for market sharing, price fixing and exchanging sensitive commercial information in relation to the supply of railway switches (JEZ Sistemas Ferroviarios)

The High Court, by Judgement of 27 December 2021 upheld the appeal filed by JEZ Sistemas Ferroviarios, S.L. (JEZ) against the Decision of the National Markets and Competition Commission (CNMC) of 30 June 2016, INFRAESTRUCTURAS FERROVIARIAS, file S/0519/14 (CNMC Decision). The CNMC Decision fined JEZ €1,075,969 for a single and continuous infringement of Article 1 of Law 15/2007, of 3 July, on the Defense of Competition (Competition Act) and Article 101 TFEU.
