The Italian Competition Authority (ICA) has closed by an infringement decision an Article 102 TFEU investigation against two major ferry operators, Compagnia Italiana di Navigazione (CIN) and Moby Spa (Moby), in the Case A487, Compagnia Italiana di Navigazione-Trasporto marittimo delle merci da/per la Sardegna (CIN-Moby) [1].The parties, Compagnia Italiana di Navigazione Spa (CIN) and Moby Spa (Moby) belonged to the same group, CIN being a wholly owned subsidiary of Moby (hereinafter the Moby-CIN group). They were found to have breached Article 102 TFEU with a complex foreclosing conduct targeting two competing ferry operators, Grimaldi Euromed Spa (Grimaldi) and Grendi Trasporti Marittimi Spa (GTM).
