The Italian Competition Authority fines four local associations for anticompetitive practices in the sector of services for thermic plants (Manutenzione impianti termici Comune di Potenza)

On September 22nd, 2011 the Italian Competition Authority (hereinafter, ICA) fined four [1] local associations of companies, artisans and cooperatives for concerted practices aimed at fixing the economic conditions for the control and maintenance of thermic plants in the City of Potenza. The investigation activity started in November 2010, in order to ascertain the existence of a violation of art. 2 of the Italian Rules for the Protection of Competition and Market (Law No. 287 of October 10, 1990). Object of the proceeding was a memorandum of intents (Protocollo d’Intesa) entered into on 30 July 2007 by and between, on one hand, the local organizations and, on the other hand, the local government, providing for the approval of a standard contract (Contratto Tipo) for the control and
